Terms of Service

These Terms of Service ("Terms") govern your use of the Purchy mobile application and website (the "Service") operated by Dynamic Dev Solutions LLC ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Use of the Service

Purchy provides receipt tracking, return deadline alerts, price monitoring, and related purchase management tools. You must be at least 13 years old to use the Service. By using Purchy, you represent that you meet this age requirement.

You agree to:

  • Provide accurate and complete information when creating an account
  • Maintain the security of your account credentials
  • Use the Service only for lawful purposes and in accordance with these Terms
  • Not attempt to gain unauthorized access to any part of the Service

2. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Upload or transmit viruses, malware, or other malicious code
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Scrape, crawl, or use automated means to access the Service without permission
  • Interfere with or disrupt the Service or its infrastructure
  • Impersonate any person or entity
  • Use the Service to infringe on the rights of others

3. Accounts and Authentication

You may create an account using email or Google OAuth. You are responsible for all activity that occurs under your account. If you connect your Gmail account, you authorize us to access receipt and order confirmation emails as described in our Privacy Policy.

You may disconnect Gmail access or delete your account at any time through the app settings or by contacting us.

4. Subscriptions and Payments

Purchy offers a free trial and paid subscription tiers. The "Purchy Pro" subscription is available as a monthly plan ($12.99/month) or annual plan ($99.99/year). A 7-day free trial is included with your first subscription.

Payment will be charged to your Apple ID account (or Google Play account) at the confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

You can manage or cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions (iOS) or Google Play Store > Subscriptions (Android). Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

We may change subscription pricing with at least 30 days' notice. Price changes will take effect at the start of your next billing period after the notice. Continued use after a price change constitutes acceptance of the new price. Refunds are subject to the policies of the applicable app store.

5. Intellectual Property

The Service, including its design, features, code, content, trademarks, and logos, is owned by Dynamic Dev Solutions LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

You retain ownership of any data you submit to the Service (such as receipt images and purchase information). By using the Service, you grant us a limited license to process and store your data solely to provide the Service to you.

6. AI-Powered Features

Purchy uses artificial intelligence to extract data from receipts, categorize purchases, and provide insights. While we strive for accuracy, AI-generated information may contain errors. You should verify important details (such as return deadlines and warranty dates) independently. We are not responsible for decisions made based on AI-generated data.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy or completeness of any data extracted from receipts or emails. Return policies, warranty terms, and pricing are set by retailers — Purchy provides reminders but is not responsible for retailer policies.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DYNAMIC DEV SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify and hold harmless Dynamic Dev Solutions LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service and delete your account at any time.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will continue to apply.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app or sending a notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Third-Party Services

The Service integrates with third-party services to provide its features, including but not limited to: Google OAuth (authentication), OpenAI (AI-powered receipt extraction and analysis), Supabase (data storage), RevenueCat (subscription management), and Brave Search (price comparison). These third-party services have their own terms and privacy policies.

We are not responsible for the availability, accuracy, or conduct of any third-party service. Your use of third-party services through Purchy is subject to those services' respective terms. If a third-party service experiences a data breach or outage, our liability is limited as described in Section 8.

13. License and Restrictions (Apple App Store)

The Purchy app is licensed, not sold, to you. This license is non-transferable and limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms of Service. You may not distribute or make the app available over a network where it could be used by multiple devices at the same time.

Dynamic Dev Solutions LLC, not Apple, is solely responsible for the licensed application and its content. Apple has no obligation to furnish any maintenance or support services with respect to the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.

Dynamic Dev Solutions LLC, not Apple, is responsible for addressing any claims relating to the app or your possession and use of it, including but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, Dynamic Dev Solutions LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

14. Data Deletion and Your Rights

You have the right to request deletion of your personal data at any time. You can delete your account and all associated data through the app's Settings screen or by emailing us at services@purchy.app. Upon receiving a deletion request, we will delete your data within 30 days, except where we are required by law to retain it.

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to request deletion, and the right to opt out of the sale of your personal information. We do not sell your personal information.

If you are a resident of the European Economic Area (EEA), you have rights under the General Data Protection Regulation (GDPR), including the right of access, rectification, erasure, restriction, data portability, and the right to object. 15. Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in New York, NY, or at another mutually agreed location. The arbitrator's decision shall be final and binding.

YOU AND DYNAMIC DEV SOLUTIONS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

You may opt out of this arbitration provision by sending written notice to services@purchy.app within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in the courts of New York as described in Section 16.

16. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in New York.
